Terms of Use

These terms are an agreement between you and Michael Alves and Peter Chi ("Findable", "we", "us") for the Findable app. By using Findable, you agree to them. Please read them along with our Privacy Policy.

Who can use Findable

You must be at least 13 to use Findable. If you're under 18, or not yet an adult where you live, you need a parent or guardian's permission.

Keep your sign-in secure. You're responsible for what happens on your account.

Your home

Your map, items and history are stored on your device and in your iCloud account, not on our servers. Findable includes backups, but we can't recover data we never had. Keep iCloud on, or export a backup now and then.

Findable helps you remember where things are. We're not responsible for items that are lost, damaged or stolen.

Community rules

Findable has zero tolerance for objectionable content and abusive users. Don't post, comment or message:

Everything shared is checked before others see it. We remove content that breaks these rules, and we may suspend or permanently ban accounts that do, without notice.

You can report any post, comment or profile, and block anyone, from the app. We review reports and act on objectionable content within 24 hours.

Your content

You own what you post. You give us a worldwide, non-exclusive, royalty-free licence to store, copy, check, display and share it within Findable for as long as it's posted, so that we can run the app and show it to other users. When you delete it, the licence ends, except for copies that stay in our backups for up to 30 days or that we need to keep to protect people or meet a legal obligation.

Make sure you have the right to post what you share, including photos of other people.

If someone makes a claim against us because of something you posted or because you broke these terms, you agree to cover our reasonable costs of dealing with it, as far as the law allows.

Copyright

We respect other people's work and expect you to as well. If you believe something on Findable infringes your copyright, email us with: your contact details, the work you say is infringed, where it appears in Findable, a statement that you believe in good faith the use isn't authorised, a statement that your notice is accurate and that you're the owner or authorised to act for them, and your physical or electronic signature. We'll remove material that's properly reported and may end the accounts of people who repeatedly infringe. If your content was removed and you believe that was a mistake, you can send us a counter-notice.

Findable Pro

The features and limits of the free and Pro plans are shown in the app. We may change them, but won't reduce what a paid period includes while you're in it.

Smart features

Scans, floor plan reads, answers and suggestions are generated automatically and can be wrong. Check them, especially measurements, before you rely on them, and don't rely on them where a mistake could hurt someone.

Links and products

Posts may link to products sold by others. We don't sell them and aren't responsible for them, their sellers or their websites.

Ending

You can stop using Findable and delete your account at any time in Settings. We may suspend or end your access if you break these terms or put others at risk.

Disclaimers

Findable is provided "as is". To the extent the law allows, we make no warranties beyond those in these terms, and we're not liable for indirect or consequential losses. Our total liability to you is limited to what you paid us for Findable in the 12 months before the claim, or $50, whichever is more.

Nothing in these terms limits rights you have under consumer law that can't be limited.

Apple

These terms are between you and us, not Apple. Apple isn't responsible for Findable or its content, and has no obligation to provide maintenance or support for it. If Findable fails to meet a warranty, you may notify Apple and it will refund the purchase price, if any; Apple has no other warranty obligation for Findable. Apple isn't responsible for any claim relating to Findable, including product liability, legal or regulatory compliance, consumer protection, or intellectual property claims; we are, as described in these terms.

You confirm that you're not located in a country under a U.S. government embargo, and that you're not on a U.S. government list of prohibited or restricted parties.

Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Governing law

These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Any dispute will be decided in the state or federal courts located in California, except that either of us may bring a claim in small claims court if it qualifies. If you live outside the United States, you keep any protections the law where you live gives you.

Changes

If we change these terms, we'll update the date at the top. If the change is significant, we'll tell you in the app first. Using Findable after that means you accept the new terms.

General

If part of these terms can't be enforced, the rest still applies. If we don't enforce a part straight away, we can still enforce it later. We may transfer these terms to a company that takes over running Findable, including one we set up for it; your rights under them stay the same.
